Kenya’s High Court orders police to produce missing Tanzanian activist Twaha Mwaipaya before it on 2 November, alive or dead. Authorities must also produce the detention warrant and justify his continued detention, following a habeas corpus petition by VOCAL Africa, according to Kenyans.co.ke.
The Milimani High Court in Nairobi has ordered the Inspector-General of Police, the Directorate of Criminal Investigations (DCI) and the head of Ruai Police Station to produce Twaha Mwaipaya before the court, alive or dead, on Monday 2 November at 11 am. Judge Alexander Muteti issued the order on Friday 30 October, according to Kenyans.co.ke.
The three officials must also hand over the original detention warrant and explain why the Tanzanian activist should not be released immediately. The order follows a habeas corpus petition filed by human rights organisation VOCAL Africa and other groups seeking to establish Mwaipaya’s whereabouts. Its chief executive, Hussein Khalid, welcomed the court’s intervention.
Mwaipaya was reportedly abducted on Sunday 25 October by armed men as he was travelling by taxi to visit friends in Kamulu, on the outskirts of Nairobi. He remains missing, according to an earlier report on the alleged abduction of Twaha Mwaipaya.
