Uganda’s High Court upholds Fredrick Ruhindi’s election as MP for Nakawa East and dismisses a challenge by Alex Waiswa Mufumbiro, a National Unity Platform candidate. Judge Allan Nshimye found that the alleged irregularities, including the exclusion of 22 polling stations, did not substantially alter the result, reports Nile Post.
Uganda’s High Court has dismissed a petition challenging the election of Fredrick Ruhindi, the National Resistance Movement (NRM) MP for Nakawa East. Judge Allan Nshimye ruled that the evidence presented by Alex Waiswa Mufumbiro, deputy spokesperson for the National Unity Platform (NUP), did not justify overturning the election, reports Nile Post.
The petition cited, among other things, the omission of results from 22 polling stations from the final tally, as well as discrepancies in electoral registers and inflated turnout figures. The court found that leaving out the results from those stations had not substantially changed the outcome of the election. It also noted that Mufumbiro had not established that he received more votes than Ruhindi.
The judge excluded several items of evidence, including uncertified photocopies of election records, ruling that they were insufficient in the circumstances presented. A witness for Mufumbiro had also claimed that turnout at Staff Nursery Primary School was 99.99%, before acknowledging in court that it was 66.78%. Each side will bear its own legal costs.
