France has reduced from 12 to six months the period during which the termination of a contract can justify refusing the first renewal of a work permit for an Algerian employee. The measure has applied since 30 October 2026, under Decree No. 2026-1001 published in the Official Journal on 29 October, Observ’Algérie reports.
The change concerns employees whose contracts are terminated after they are hired and who are seeking a new employer. The decree also adds an exception when the termination results from a serious breach of working conditions by the employer. The authorities will nevertheless continue to examine each application and compliance with the conditions attached to the work permit.
The decree amends Article R. 5221-36 of the Labour Code. Algerian nationals remain subject to the Franco-Algerian agreement of 27 December 1968, which notably provides for a one-year residence certificate bearing the word “employee” for carrying out professional activity in France, according to the French Interior Ministry.
