DR Congo’s Mines Minister, Louis Watum Kabamba, is bringing back into focus the provision reserving 5% of mining companies’ capital for their Congolese workers. Set out in the 2018 mining regulations, this share forms part of a rule requiring at least 10% participation by Congolese individuals, according to Deskeco.
The mining regulations of the Democratic Republic of the Congo reserve 5% of mining companies’ capital for their Congolese workers, Deskeco reports. This provision stems from the 2018 reform of the Mining Code, whose Article 71 bis provides for at least 10% participation in the capital of mining companies by Congolese individuals.
The allocation set out in the regulations assigns part of this participation to workers. It is intended to allow them to hold shares in companies exploiting the country’s resources and to benefit from dividends when results permit, according to Deskeco.
Mines Minister Louis Watum Kabamba is putting the provision back on the mining agenda in 2026. The terms for acquiring and valuing shares, the rights of existing shareholders and the protection of investments are among the legal and financial issues to be addressed, according to Deskeco. The policy is being pursued under the authority of Prime Minister Judith Suminwa Tuluka and President Félix Antoine Tshisekedi Tshilombo.
