A French administrative court ruled in favour of an Algerian national who challenged the implied refusal to renew her “private and family life” residence certificate. The decision, issued in late October 2026, places obligations on the Hauts-de-Seine prefecture following proceedings before the Cergy-Pontoise Administrative Court, according to ObservAlgérie.
The Cergy-Pontoise Administrative Court suspended the implied refusal to renew the residence certificate of an Algerian woman legally living in France since 2023. In an order issued on Tuesday 27 October 2026, the urgent applications judge ordered the Hauts-de-Seine prefecture to review her situation, following an appeal she filed with the help of Me Fayçal Megherbi, a lawyer at the Paris Bar, according to Observ’Algérie.
The applicant submitted her renewal request, for a certificate bearing the designation “private and family life”, on 12 December 2024. The court found that the case was urgent and identified serious doubts about the legality of the refusal under Article 6-2 of the Franco-Algerian agreement of 27 December 1968, which governs the issuing of certain residence certificates to Algerian nationals, Observ’Algérie reports.
