Tunisia to regularise unauthorised farm wells for 3,500 dinars

Tunisia’s Assembly of the Representatives of the People has passed a law allowing unauthorised agricultural wells to be regularised for a fee of 3,500 dinars. Operators will have one year to submit applications after the procedures set by the minister responsible for Water Resources are published, according to Businessnews.

Tunisia’s Assembly of the Representatives of the People (ARP) adopted a bill to regularise unauthorised agricultural wells built before its adoption, for a fee of 3,500 dinars. The bill received 79 votes in favour, seven against and ten abstentions, Businessnews reports.

The operators concerned will be able to benefit from provisions in Tunisia’s 2016 investment law and 2017 tax incentives law, but cannot claim them retroactively. Applications must be submitted within one year of the publication of the decision by the minister responsible for Water Resources, who will set the conditions and procedures.

The law provides for the rejection of applications containing inaccurate information and for the cancellation of regularisation if a beneficiary fails to meet their obligations. It also repeals Article 81 of Tunisia’s 2025 Finance Act, adopted on 9 December 2024.

The adoption follows several legislative debates in Tunisia, including consideration of a bill on shared custody after divorce on 21 October. The 2027 budget also provides for expenditure of 68.9 billion dinars, up 8.4% on the previous year.
