A US federal judge has ordered the reinstatement of Maurene Comey, a former federal prosecutor in New York, ruling that her dismissal by the Trump administration was unlawful. The Department of Justice is challenging the decision and plans to appeal, reports the BBC.

US federal judge Jesse Furman has ordered the reinstatement of Maurene Comey, a former federal prosecutor in New York who was dismissed in July 2025, and the payment of her unpaid salary through December 2025. He ruled that the US Department of Justice had violated the Constitution and the prosecutor’s right to due process, according to the BBC.

Jesse Furman ruled that the attorney general could dismiss federal prosecutors, but only through a specific procedure and on certain grounds. Maurene Comey argued that she was dismissed because of her relationship to her father, James Comey, a former FBI director and critic of Donald Trump, or because of her alleged political views.

The Department of Justice rejected the decision and said it would appeal. Maurene Comey had worked on cases involving, among others, Jeffrey Epstein, Ghislaine Maxwell and rapper Sean “Diddy” Combs, who was convicted last year of offences related to prostitution.

The ruling comes a day after a judgement found the dismissal of Maurene Comey unlawful. It also comes amid prosecutions brought by the Trump administration against James Comey, including charges of lying to Congress and threatening the president, which he denies.
