Nigeria’s Court of Appeal dismissed Senator Sahabi Ya’u Kaura’s appeal and upheld the annulment of the APC primary for the Zamfara North senatorial seat. The ruling requires a new internal election after the court found that party rules had not been followed, according to Sani Abdullahi Shinkafi’s lawyer, quoted by Vanguard.
Nigeria’s Court of Appeal sitting in Sokoto has dismissed Senator Sahabi Ya’u Kaura’s appeal against a ruling ordering a new primary for the All Progressives Congress (APC) in the Zamfara North senatorial district. It upheld the Federal High Court in Gusau’s judgment, according to the lawyer for Sani Abdullahi Shinkafi, the APC candidate in the district.
The appeal court found that the Federal High Court had jurisdiction to hear the case and rejected the argument that it had reversed the burden of proof, lawyer Bello Galadi said. According to him, the evidence showed that the APC’s rules and guidelines had not been followed.
The Federal High Court had ordered the APC to hold a new primary within 14 days. Shinkafi had taken the case to court, arguing that no primary had been held in Zamfara North and that the process was irregular. Kaura challenged that decision on appeal.
After the judgment, Shinkafi urged his supporters in Shinkafi, Birnin Magaji, Zurmi and Kaura Namoda to continue their campaign for fair political representation.
